Difference Between Patent and Utility Model
One of the most frequently asked questions is “What is the difference between patent rights and utility model rights”?
To put it simply, inventions are protected under patent rights while devices are protected under utility model rights. However, inventions and devices are common in that the definitions of them both include “creation of technical ideas utilizing the laws of nature”. So it is sometimes difficult to accurately understand the difference between a patent and a utility model.
The main difference between patent rights and utility model rights is that
an examination on novelty, description and other certain requirements has
been conducted before the grant of patent rights while this kind of substantive
examination has not been done before the grant of utility model rights.
